These Terms & Conditions (“Terms”) govern your access to and use of the websites, online store, and services operated by Oliva Beauty (“Oliva Beauty,” “we,” “us,” or “our”). By accessing or using our site or purchasing our products, you agree to these Terms and to our Privacy Policy, Payment Policy, Shipping Policy, Refund & Returns Policy, and Sales Policy (collectively, the “Policies”). If you do not agree, do not use our services.

2) Eligibility & account

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase.

  • You are responsible for the accuracy of account information and for safeguarding your login credentials. Notify us immediately of any unauthorized use.

3) Orders, pricing, and availability

  • Your order is an offer to buy; we accept when we send an order confirmation or dispatch notice.

  • We may refuse or cancel orders for reasons including pricing or availability errors, policy violations, or fraud concerns.

  • Prices, promotions, and product availability can change without notice. Taxes, duties, and shipping charges are shown at checkout as applicable.

4) Product information & use

  • We aim to display product details accurately; minor variations (e.g., packaging, shades) can occur.

  • Our skincare and beauty products are for external use only. Perform a patch test before full use. Discontinue use and consult a professional if irritation occurs.

  • We do not provide medical advice and do not make medical claims; our products are not intended to diagnose, treat, cure, or prevent any disease.

5) Promotions, coupons, bundles, and gifts

  • Promotions run for limited times and may carry exclusions or per-customer limits.

  • Coupons must be entered at checkout and cannot be applied retroactively.

  • Gifts-with-purchase and bundles are governed by our Sales and Refund & Returns Policies.

6) Payments, billing & fraud prevention

  • We accept the payment methods shown at checkout and process payments via PCI DSS–compliant providers.

  • We may request additional verification, limit order values, or cancel transactions suspected of unauthorized or high-risk activity.

7) Shipping, risk of loss & title

  • Processing times, carriers, tracking, and delivery estimates are covered in our Shipping Policy.

  • Risk of loss passes per that policy; title passes upon full payment.

8) Returns, exchanges & refunds

  • Eligibility windows, conditions, and procedures are set out in our Refund & Returns Policy.

  • Approved refunds are issued to the original payment method unless otherwise stated.

9) User content (reviews, photos, comments)

  • If you submit reviews, photos, or other content (“User Content”), you grant Oliva Beauty a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, publish, translate, distribute, display, and create derivative works in any media for marketing and operational purposes.

  • You represent that you own or control all rights in your User Content and that it is accurate, lawful, and non-infringing. We may moderate or remove content at our discretion.

10) Acceptable use

You agree not to:

  • Violate laws or third-party rights; upload malware; scrape or crawl our services without permission.

  • Misrepresent your identity; engage in fraud; attempt to bypass security; or interfere with normal site operation.

15) Limitation of liability

To the maximum extent permitted by law, Oliva Beauty and its officers, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of the services or purchase of products. Our total liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim.

17) Dispute resolution; arbitration; class waiver

  • Except where prohibited or where you may bring an individual claim in small-claims court, any dispute arising out of or relating to these Terms or our products/services will be resolved by binding individual arbitration on an individual basis.

  • Class actions and class arbitrations are not permitted. The arbitrator may award relief only in favor of the individual party seeking relief.

  • You and we retain the right to seek injunctive or equitable relief in a court of competent jurisdiction to prevent actual or threatened misuse of IP or confidential information.

Note: Some jurisdictions do not allow mandatory arbitration or certain waivers; in those places, the foregoing may not apply to you.

18) Governing law & venue

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-laws principles. Subject to the arbitration clause, the courts located in Milwaukee, Wisconsin shall have exclusive jurisdiction for permitted court proceedings.

19) Suspension & termination

We may suspend or terminate access to the services, or cancel orders, if you violate these Terms, our Policies, or applicable law, or if we suspect fraud or abuse. You may stop using the services at any time.

20) Changes to the services and to these Terms

We may modify or discontinue any part of the services at any time. We may update these Terms periodically; the “Last updated” date shows the latest version. Changes take effect when posted and apply to future use and orders. Continued use after changes means you accept the updated Terms.

21) Communications & e-sign consent

By creating an account or making a purchase, you agree to receive transactional emails (e.g., order updates). Marketing emails are sent only with consent where required, and you can unsubscribe at any time. You consent to conduct transactions electronically and accept electronic records as legally equivalent to paper versions.
